Halle Berrys ex loses court appeal to see their daughter as it emerges he probably wont face charges over Olivier Martinez brawl

Since his vicious brawl with Olivier Martinez on Thanksgiving, Gabriel Aubry has been legally barred from being within 100 yards of his 4-year-old daughter Nahla and her mother Halle Berry and despite a further appeal to the courts the model has now been unable to get the protective order lifted.
Aubry’s face was left badly wounded by Martinez, a former boxer, during the fight which apparently kicked off when Nahla was being dropped round his house.
Martinez didn’t walk away from the brawl unharmed either – he sustained a broken hand plus bruises and cuts.
It’s unlikely Aubry will face charges for the tussle as apparently in the eyes of the law it counts as “mutual combat”.
Due to a clerical error the restraining order against Aubry will end earlier than expected, tomorrow to be precise - however Halle could file to have it extended.
The former couple have been embroiled in a bitter custody battle lately over Halle’s plan to move to Paris with Martinez.
